Terms of Service

These Terms of Service ("Terms") govern your access to and use of exemian.com and its services (collectively, the "Product"), operated by Exemian. By accessing or using the Product, you agree to be bound by these Terms. If you do not agree, do not use the Product.

1. Description of Service

Exemian provides AI-powered assessments ("AI-Proof Score") that measure users' readiness for AI adoption across various dimensions. The Product includes:

  • Free adaptive assessments with instant score results
  • Paid personalized reports generated by artificial intelligence
  • User accounts with test history
  • Shareable result cards

2. Eligibility

You must be at least 18 years old to use the Product. By using the Product, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. User Accounts

3.1. Registration

You may create an account by providing your email address. We use passwordless authentication (magic link) to verify your identity. You are responsible for maintaining the security of your account.

3.2. Accuracy

You agree to provide accurate, current, and complete information when using the Product. Providing false information may result in termination of your account.

3.3. Account Security

You are responsible for all activity that occurs under your account. Notify us immediately at support@exemian.com if you suspect unauthorized access.

4. Free Services

The AI-Proof Score assessment is available free of charge. Free services include:

  • Taking the adaptive assessment
  • Receiving your overall score and dimension breakdown
  • Sharing your results on social platforms
  • Viewing your test history (when logged in)

We reserve the right to modify, limit, or discontinue free features at any time.

5. Paid Services

5.1. Reports

Personalized AI-Proof reports are available for purchase. Reports include strengths analysis, gap identification, AI tool recommendations, and a 30-day action plan tailored to your score and background.

5.2. Pricing

Prices are displayed at checkout and include applicable taxes. All prices are in the currency shown at the time of purchase. We reserve the right to change pricing at any time; changes will not affect previously completed purchases.

5.3. Payment Processing

Payments are processed by our third-party payment processor, which acts as the merchant of record. The payment processor handles all payment processing, tax collection, invoicing, and receipts.

5.4. Delivery

Purchased reports are delivered via email to the address associated with your assessment. Reports are typically delivered within 10 minutes of purchase. If you do not receive your report, contact us at support@exemian.com.

5.5. Refund Policy

Due to the digital and personalized nature of our reports (generated specifically for your assessment results), all sales are generally final. However, we evaluate refund requests on a case-by-case basis. You may request a refund within 14 days of purchase by contacting support@exemian.com. Refunds may be granted if:

  • The report was not delivered due to a technical error
  • The report content is substantially incomplete or corrupted
  • A duplicate charge occurred

6. AI-Generated Content

6.1. Nature of Content

Reports and recommendations are generated using artificial intelligence. AI-generated content is provided for informational and educational purposes only.

6.2. No Professional Advice

Our reports do not constitute professional career advice, business consulting, financial advice, or any other form of professional guidance. You should consult qualified professionals before making significant career or business decisions.

6.3. Accuracy

While we strive for high-quality, relevant recommendations, we do not guarantee the accuracy, completeness, or suitability of AI-generated content. AI tools and platforms recommended may change, be discontinued, or have different features than described.

7. Intellectual Property

7.1. Our Property

The Product, including its design, code, questions, scoring methodology, algorithms, branding, and all associated intellectual property, is owned by Exemian and protected by applicable intellectual property laws.

7.2. Your Content

You retain ownership of the information you provide (background details, assessment answers). By using the Product, you grant us a license to process this data as described in our Privacy Policy.

7.3. Reports

Purchased reports are licensed for your personal use. You may share excerpts or your score publicly, but you may not resell, redistribute, or commercially exploit the full report content.

8. Acceptable Use

You agree not to:

  • Use the Product for any unlawful purpose
  • Attempt to access accounts, data, or systems belonging to others
  • Interfere with, disrupt, or overload the Product
  • Scrape, copy, or reproduce the assessment questions, scoring methodology, or content
  • Create multiple accounts to circumvent payment requirements
  • Use automated tools (bots, scripts) to interact with the Product
  • Reverse engineer, decompile, or attempt to extract the source code
  • Impersonate any person or entity
  • Submit false, misleading, or malicious data

9. Limitation of Liability

To the maximum extent permitted by law:

  • The Product is provided "as is" and "as available" without warranties of any kind, express or implied
  • We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total aggregate liability shall not exceed the amount you paid to us in the 12 months preceding the claim
  • We are not liable for any actions you take based on AI-generated recommendations

10. Indemnification

You agree to indemnify and hold harmless Exemian and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Product, violation of these Terms, or infringement of any third-party rights.

11. Termination

11.1. By You

You may stop using the Product at any time. You may request account deletion by contacting support@exemian.com.

11.2. By Us

We may suspend or terminate your access to the Product at any time, with or without notice, for conduct that violates these Terms, is harmful to the Product, other users, or third parties, or for any other reason at our sole discretion.

11.3. Effect of Termination

Upon termination, your right to use the Product ceases immediately. Sections regarding intellectual property, limitation of liability, indemnification, and dispute resolution survive termination.

12. Dispute Resolution

Any disputes arising from these Terms or the Product shall first be attempted to be resolved through informal negotiation by contacting support@exemian.com. If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with applicable laws.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Exemian operates, without regard to conflict of law principles.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Exemian regarding the Product and supersede all prior agreements.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on the Product. Continued use of the Product after changes become effective constitutes acceptance of the updated Terms.
